Terms & Conditions
The IMF Virtual Run is a fundraising initiative of the Indigenous Marathon Foundation Limited (ABN 39 162 317 455) (“the Foundation”) to raise funds to support the Foundation’s five programs (“the Event”). From 1 September 2026 to 30 September 2026, participants will run, walk or roll 42.2km (or more) to support the Foundation to nurture First Nations leaders. By registering as a participant in the Event, I am agreeing to accept and comply with the following terms and conditions:
General
- I am at least eighteen (18) years old.
- If I am not eighteen (18) years old, I have permission from my parent or guardian to participate.
- My decision to participate in the Event is entirely voluntary and my own. I understand I am free to withdraw from the Event at any time if I do not wish to proceed.
- I understand and acknowledge that I take full responsibility for any consequence of my participation in the Event. I agree to carefully consider the risks of my participation in the Event prior to participating, including but not limited to the risks of harm associated with physical exertion. I warrant that I am physically fit enough to participate safely in the Event and I understand it is my sole responsibility to consult with a doctor before participating in the Event to discuss any conditions that may impede my ability to participate safely in the Event. Regardless of whether I have consulted with a doctor, I am aware of the risks of participating and voluntarily assume and accept those risks.
- In consideration of and as a condition of acceptance of my participation in the event for myself, my heirs, executors and administrators, I:
- waive, release and discharge the Foundation (including its directors, staff, agents and independent contractors, volunteers and sponsors) (“the Indemnified Parties"), from all and any liability including all claims or causes of action which I might otherwise have (including for negligence) arising from any injury, loss, or damage of whatever kind suffered or sustained by me arising directly or indirectly out of my participation in the Event; and
- indemnify the Indemnified Parties against any claim, action, liability, loss, damage, cost or expense that the Indemnified Parties incur or are liable for as a result of my participation in the Event; and
- agree not to bring any claim against the Foundation for loss or damages, regardless of whether negligence can be demonstrated.
- I acknowledge that the Foundation will not insure me in relation to any aspect of the Event and I agree that I am responsible for all necessary insurance to cover my participation in the Event.
- During my participation in the Event, I agree to adhere to all public health rules and regulations in my State or Territory or the State or Territory in which I complete the Event.
Fundraising
- I acknowledge that by registering to participate in the Event, I pledge to raise funds for the Foundation.
- As part of registration for the Event, I will set up a fundraising profile (“my Profile”) on https://www.everystep.orf.au/ (“Event Website”) and promote my Profile to seek donations from the public for my participation in the Event. I will ensure that all donations are made via my Profile and, in particular, will not accept any donations directly. I acknowledge that the donations are for the Foundation and are remitted directly to the Foundation.
- I understand that I am authorised by the Foundation to fundraise for this Event in the State or Territory in Australia in which I am fundraising. I agree to be bound by the fundraising legislation relevant to that State or Territory. If I have any questions about my obligations, I will contact info@imf.org.au.
- If I am not fundraising in Australia, it is my responsibility to ensure that I am fundraising in accordance with all applicable laws in my country.
Content
- I understand and acknowledge that any content that I post to the Event Website (for example, photos and videos) (“Content”) is my responsibility, I warrant that copyright in the Content is owned by me and that the Content does not infringe the copyright, moral rights or other rights of any third party. I indemnify and keep the Foundation indemnified against any claim by a third party in relation to the Content. By posting the Content on the Event Website, I grant the Foundation a perpetual, royalty free, transferable, and non-exclusive licence to use, copy, reproduce, modify, broadcast, communicate or sublicense the Content (in whole or in part) for the promotion of the Event or the Foundation in any manner or media worldwide.
Merchandise Terms
Returns and Refunds Overview
Our general refund and returns policy lasts 30 days. If 30 days have passed since your purchase, we can’t offer you a full refund or exchange.
To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.
Additional non-returnable items:
- Gift cards
- Downloadable software products
To complete your return, we require a receipt or proof of purchase.
Please do not send your purchase back to the manufacturer.
There are certain situations where only partial refunds are granted:
- Book with obvious signs of use
- CD, DVD, VHS tape, software, video game, cassette tape, or vinyl record that has been opened.
- Any item not in its original condition, is damaged or missing parts for reasons not due to our error.
- Any item that is returned more than 30 days after delivery
Refunds
Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.
If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.
Late or missing refunds
- If you haven’t received a refund yet, first check your bank account again.
- Then contact your credit card company, it may take some time before your refund is officially posted.
- Next contact your bank. There is often some processing time before a refund is posted.
- If you’ve done all of this and you still have not received your refund yet, please contact us.
Sale items
Only regular priced items may be refunded. Sale items cannot be refunded.
Exchanges
We only replace items if they are defective or damaged. If you need to exchange it for the same item, send us an email at info @ imf.org.au and send your item to:

Shipping returns
To return your product, you should mail your product to: Indigenous Marathon Foundation – PO Box 6127, Mawson ACT 2607.
You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.
Depending on where you live, the time it may take for your exchanged product to reach you may vary.
If you are returning more expensive items, you may consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.

Privacy and Data handling
The Indigenous Marathon Foundation (‘IMF’, ‘we’, ‘us’, ‘our’ and ‘Foundation’) and IMF entities related are totally committed to protecting your personal information. We collect information by various means, including but not limited to events, IMF Program activities, fundraising activities, the IMF website, the IMF-RAW Connect App and through the sale of IMF merchandise.
Collection of personal information
Personal information
‘Personal information’ is any information or opinion that can identify or be used to identify you. We collect and hold personal information from our donors, supporters, volunteers, contractors, visitors to our field programs, and other individuals.
For example, if you are a runner, we would collect and hold your name, address, e-mail address, phone number, gender, weight, Aboriginal and Torres Strait Islander heritage if any and activity information like, distances run, personal bests and the type of activities achieved.
We DO NOT collect credit card or bank account details from donors.
Collection
We collect personal information directly from individuals. For example, when you make a donation, register as a user/runner on the IMF Website, the IMF-RAW Connect App and send us a query via the IMF-RAW Connect App Portal.
Dealing with us anonymously
You may request us to deal with you anonymously or through a pseudonym. We will accommodate your request if it is lawful and practical for us to do so. For example, it may not be possible for us to process your donations or accept you as a volunteer if you do not provide the necessary personal information.
Disclosure of personal and sensitive information
We do not disclose personal information to other external organisations unless we believe it is reasonably necessary to conduct the functions and activities of the Foundation, if you give your consent or if it is required or authorised by law including in emergency situations or to assist law enforcement.
We may collect sensitive information such as information about your health. We do not share nor disclose sensitive and personally identifiable information to external organisations and individuals without your prior written consent. We ensure that we comply with privacy laws whenever we handle sensitive and personally identifiable information.
Information and activities captured via methods like the IMF-RAW Connect App, will enable us to generate reports using aggregated data on all who installs and uses the App.
Account deletion
If you are a registered account user of this site, you will be able to cancel your account at any time.
You may cancel your account at any time by clicking on the “Cancel Account” button and following the cancellation procedure. At cancellation, your account will be inactivated, and you will no longer be able to log into that account. IMF may terminate your account at any time if you breach or otherwise fail to comply with the the site’s Terms and Conditions of Use.
All personally recognisable information will be deleted upon the cancellation of your account. Any reference to your activities, sessions and events attended, will be replaced with and attributed to “Former member”.
Use of Photos
The images and photos we take are used to grow and connect Indigenous and Non-Indigenous communities in all parts of Australia. We will use photos to capture and celebrate the achievements of individuals and their constituent communities and will enthusiastically use these photos to promote IMF programs. If you do not wish your photo to be used, please make it known to the person heading the activity that you’re involved in. For example, the Run Group Leader if you’re a part of an IMF RAW Running Group.
Security of personal information
We take reasonable steps to ensure the security of personal information by storing it in a secure environment. If contract service providers are used they will be bound by our privacy policy. We require our employees, contractors, and third party service providers to respect and protect the confidentiality of personal information we hold.
Our electronic database is secured by a firewall and anti-virus software to ensure, so far as practicable, that it is not accessed by unauthorised parties. This website has security measures (minimum 128-bit secure sockets layer encryption) designed to protect against the loss, misuse and/or alteration to your personal information under our control. Secure pages on our website are protected by a 128-bit SSL certificate. A security icon visible on your screen, for example a padlock, confirms that your browser supports SSL security.
However, all unencrypted information exchanged via the internet may be accessed and used by people other than those for whom it is intended, for example if you send us any personal information by email it is sent at your own risk.
Donations
Donations can be made via this website and via our fundraising platform, GoFundraise. All donations are directed to and are processed in real time using a secure payment gateway on the GoFundraise website. Donations are processed in Australia (and for all other countries) in Australian Dollars. Access to personal information
We take reasonable steps to ensure that personal information we collect, hold, use and disclose is complete, accurate, relevant and up-to-date.
If you would like to access or make corrections to your personal information, please contact us at info@imf.org.au or by phone during office hours on +61 477 111 477. We may ask you to verify your identity before we disclose any personal information.
If you wish to have your personal information removed from our database, we will take reasonable steps to comply with your request unless we need to keep your information for legal, auditing or internal risk management reasons.
